We believe that every home needs a fence, because a house just isn’t complete without one. Fences are a great way to decorate your home, and can be used to deter unwanted guests from entering your property. However, it’s important to check fencing codes in your area before putting one up – whether it’s for a private or a commercial property. Checking your local Orange County fencing codes is important to ensure that you’re not breaking any rules or regulations.
Today, we’ll be focusing on fencing codes and policies in Orange County, California. The OC housing opportunities manual states that fencing should be considered to provide privacy and to establish boundaries between public, private, and neighboring spaces. Orange County regulations consider fences, walls, retaining walls, sound attenuation walls, and screens as a part of the “fences and walls” category. Everything that falls under the “fences and walls” category needs to follow Orange County fencing policies and guidelines.
For example, in Irvine (a large city within Orange County), permits are not required for fences shorter than 7 feet high. Permits are also not required for fences that retain over 18 inches of earth. However, according to the City of Irvine website, height limitations may still apply. Fence heights will be measured from the bottom (base) to the top of the interior/exterior.
Bordering Streets
Orange County fencing regulations are especially strict for bordering streets. For these areas, the maximum height for fences should be three and one-half (3 ½) feet from front setback areas and within 6 feet of rear or side setback areas adjoining a street. Fences requiring sound attenuation that border freeways and highways can only be 6-8 feet high, depending on certain circumstances. The exteriors of the walls cannot be more than six feet, and the freeways must be 2 feet higher than the building site.
Non-Bordering Streets
The maximum high for fences should be 6 feet total for all sides not adjoining a street, according to Orange County fencing codes. However, if the elevation of an adjoining building site is higher than the base of the fence, the height of the fence may be measured from the elevation to the top of the fence.
The fence height still cannot go over 8 feet. At access intersection areas, the maximum height is 3 ½ feet within 5 feet from various points of intersections, including: street right-of-way lines and interior property lines, driveway edges, and alley right-of-way lines. At street intersections, the maximum height can only be 3 ½ feet within a triangular area from 2 points.
Modifications
Fencing modifications may need permits from Zoning Administrators. This is to prevent traffic hazards and obstructions.
